Terms of Service
These terms explain how DELYV works and what we each expect from the other. DELYV is a brand of Rakstar Holdings LLC ("DELYV", "we", "us"). By creating an account, buying a plan or task, or sending us a request, you agree to these terms and to our Privacy Policy. If you use DELYV for a business, you confirm you can agree on its behalf.
What DELYV does
You send DELYV tasks such as research, administrative work, writing, planning and scheduling. A DELYV team member reviews each request, confirms the scope, and a person completes the work and delivers it to your private workspace. DELYV is a task service. We do not provide legal, medical, financial, tax or other licensed professional advice, and you should not rely on our work as a substitute for it.
Your account
- Give us accurate information and keep your password private. You are responsible for activity on your account.
- You must be at least 18 years old, or the age of majority where you live.
- The free trial is limited to one per person. We may end a trial or account that is being abused.
- You need to confirm your email address before you can spend free trial tokens.
Requests, tokens and approval
DELYV measures work in tokens. Before work begins, we show you the token cost and an estimated delivery time, and you approve it. Estimates are our best judgement and are not guaranteed dates. If a request turns out to be bigger than first scoped, we will tell you before doing more, and larger projects may be quoted or split into phases.
Plans, one-time tokens and payment
- Monthly plans renew each billing period until you cancel. Plan tokens reset each billing period and do not carry over.
- One-time tasks and packs stay usable for 3 months from purchase, then expire.
- Free trial tokens are a one-time allowance and have no cash value.
- Payments are processed by Stripe. We never see or store your full card number. Prices are shown in US dollars and may change for future purchases, with notice for existing plans.
- Task counts on our pages, such as "about 10 standard tasks", are estimates. Actual usage depends on the size of your requests.
Cancelling and refunds
You can cancel a monthly plan yourself from Settings at any time. It stops renewing at the end of your current billing period, and you keep access and any remaining plan tokens until then. Payments are otherwise non-refundable, except where the law requires it or where we agree to a refund in writing. If you believe you were charged in error, email hello@getdelyv.com and we will look into it.
Corrections
If finished work is not what you asked for, open the request and ask for a correction. It goes back to the team to put right. If the correction asks for something beyond the original scope, we will tell you plainly before treating it as new work.
Your content and our work
- You keep ownership of the materials and information you send us.
- You give us permission to use them, and to share them with the people and services that help complete your request, only as needed to do the work and run the service.
- Once you have paid for a task, you may use the finished deliverable for your own purposes. We keep the right to reuse general know-how and our own tools and templates.
- You promise you have the right to send us what you send, and that it does not break the law or anyone else's rights.
What you agree not to do
Do not use DELYV for anything unlawful, deceptive, harassing or harmful; to send content you do not have the right to share; to try to break into or disrupt the service; or to resell the service without our written permission. We may decline a request or suspend an account that breaks these rules.
Messages and notifications
We send account and service messages by email, in the app and, if you opt in, by text message and push notification. Message and data rates may apply to texts. You can turn notifications off in Settings or reply STOP to a text to opt out.
Service availability
We work to keep DELYV available and accurate, but the service is provided "as is" and "as available". We do not promise uninterrupted access or that every result will meet your needs.
Limits on our liability
To the fullest extent the law allows, Rakstar Holdings LLC is not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim relating to the service is limited to the amount you paid us in the 3 months before the claim arose. Nothing in these terms limits liability that cannot legally be limited.
Ending your use
You can stop using DELYV at any time. We may suspend or end access if you break these terms or if we must do so by law. Sections that by their nature should continue, such as ownership, payment and liability, continue after your account ends.
Changes to these terms
We may update these terms. If a change is significant we will tell you, for example by email or in the app. Continuing to use DELYV after a change means you accept it.
Governing law
These terms are governed by the laws of the state in which Rakstar Holdings LLC is organized, without regard to conflict-of-law rules, and any dispute will be handled in the courts located there, unless the law where you live requires otherwise.
